1. Purpose and acceptance
These Terms and Conditions (hereinafter, the «Terms») govern the contractual relationship between Kulunka S.L. (NIF B95412813), owner of the ScanGrounded service, and any user who accesses or subscribes to it. Accessing or using the service implies full acceptance of these Terms. If you do not agree, you must refrain from using the service.
2. Service description
ScanGrounded is a web-based document digitisation application that uses artificial intelligence to detect and extract data from images of physical documents (receipts, delivery notes, invoices, etc.). The service is provided through the user's web browser with no installation required. Image processing takes place on the user's device; AI inference is performed via Google AI services through a dedicated proxy that does not retain document content.
3. Registration and user account
Access is available anonymously (with reduced limits) or via registration with a valid email address or Google account. The user is responsible for maintaining the confidentiality of their access credentials and for all activity carried out under their account. Users must be at least 16 years of age (or the minimum age applicable in their jurisdiction). Kulunka S.L. reserves the right to suspend or terminate accounts that violate these Terms.
4. Plans, pricing and billing
ScanGrounded offers a free plan with a monthly extraction limit and a Pro plan (€9.90/month, VAT not included) with unlimited extractions. Pro plan payments are processed monthly via Stripe. The price covers access to all plan features during the active period. Prices may be modified with at least 30 days' prior notice. Billing is made in advance at the start of each period.
5. Right of withdrawal
In accordance with EU Directive 2011/83 on consumer rights, you have the right to withdraw from the contract within 14 calendar days of subscription without giving any reason. To exercise this right, you must notify us in writing at scangrounded@scangrounded.com before the period expires.
Waiver of the right of withdrawal
Since ScanGrounded begins to be provided immediately after subscription, and in accordance with Art. 16(m) of Directive 2011/83/EU, you expressly acknowledge that once service execution has begun, the right of withdrawal no longer applies. By confirming payment for the Pro plan, you accept this condition.
6. Cancellation and refunds
You may cancel your Pro subscription at any time from your account settings, without penalty. Cancellation takes effect at the end of the current billing period, and you retain access until that date. No refunds are issued for already-billed periods, except where the right of withdrawal applies or where there is a material defect in the service.
7. Acceptable use
You agree to use the service in accordance with applicable law and to refrain from the following:
- Processing images containing third-party data without their consent.
- Using the service for illegal, fraudulent, or rights-infringing activities.
- Attempting to circumvent usage limits, authentication mechanisms, or service security measures.
- Reverse engineering, decompiling, or disassembling any part of the service.
- Transmitting viruses, malware, or any destructive code through the service.
8. Intellectual property
Kulunka S.L. holds all intellectual and industrial property rights over the ScanGrounded service, including its source code, design, brand, logos, and documentation. The user receives only a non-exclusive, non-transferable, revocable licence to use the service in accordance with these Terms. Nothing in these Terms constitutes a transfer of intellectual property rights to the user.
9. Limitation of liability
The service is provided «as is» and «as available». Kulunka S.L. does not guarantee that the service will be uninterrupted, error-free, or that AI extraction results will be accurate in all cases. To the maximum extent permitted by applicable law, Kulunka S.L.'s total liability to the user shall not exceed the amounts paid by the user in the 12 months prior to the event giving rise to the claim. Kulunka S.L. shall not be liable for indirect, incidental, special, or consequential damages.
10. Amendments to the Terms
Kulunka S.L. may amend these Terms by notifying users at least 30 days in advance via email or a prominent notice within the service. If a user does not accept the new Terms, they may cancel their subscription before the effective date of the changes at no additional cost.
11. Applicable law and jurisdiction
These Terms are governed by Spanish law. Any disputes shall be subject to the Courts and Tribunals of Bilbao, without prejudice to any mandatory consumer jurisdiction applicable under relevant law.
